1. Agreement

These Terms are a legal agreement between you and MSM Solutions (“we”, “us”) about your use of Measure Now (the “app”) and our website. By downloading or using the app you agree to these Terms. If you do not agree, do not use it. You also agree to Apple’s Licensed Application End User License Agreement (“Apple EULA”) unless we provide a separate one. If these Terms conflict with the Apple EULA, these Terms apply to the extent permitted by Apple’s rules.

2. License

We grant you a limited, personal, non-exclusive, non-transferable, revocable license to install and use the app on Apple devices you own or control, as allowed by the App Store Usage Rules. You may not copy, modify, reverse engineer, decompile, rent, lease, sell, sublicense or create derivative works of the app, except where applicable law allows it despite this restriction.

3. Measurements are estimates

The app estimates distances, areas, angles and sizes using your device’s camera and sensors. Results can be affected by lighting, surface texture, reflections, movement, device condition and how you use the app, and may be wrong.

• Do not rely on the app for work that must be exact or safety-critical, such as structural, electrical, plumbing, medical, legal, surveying or engineering decisions, or for cutting materials without checking.
• Always verify important measurements with a calibrated physical tool or a qualified professional.
• Ring size and other conversion results are guides only.

4. Safe use

You use the app at your own risk. Pay attention to your surroundings, do not walk while looking at the screen, do not use the app while driving, and do not use it in places where camera use is prohibited or unsafe. Do not climb or reach to measure at heights or near hazards. Respect other people’s privacy and property when you take photos.

5. Acceptable use

You agree not to: use the app unlawfully; interfere with or attempt to bypass its security or purchase checks; use it to harm or harass anyone; or infringe anyone’s rights. You are responsible for the photos and measurements you create and share.

6. Pro and purchases

Some features may require a paid upgrade (“Pro”). Prices, billing period and what Pro includes are shown in the app before you buy. Purchases are made through your Apple Account and processed by Apple.

• Subscriptions (if offered): they renew automatically unless cancelled at least 24 hours before the end of the current period. You can manage or cancel in your Apple Account settings. Payment is charged to your Apple Account at confirmation of purchase. Any unused part of a free trial is forfeited when you purchase a subscription.
• One-time purchases (if offered): they unlock Pro for the Apple Account that bought it, and you can restore them with “Restore Purchases”.
• Refunds: Apple handles refund requests (reportaproblem.apple.com). We cannot issue refunds for App Store purchases.

7. Intellectual property

The app, its design, text, graphics, code and trademarks belong to us or our licensors and are protected by law. We do not claim ownership of the photos and measurements you create. You give us no license to them because they stay on your device unless you send them to us.

8. Feedback

If you send us ideas or feedback, you allow us to use them without obligation to you.

9. Third-party services

The app relies on Apple technologies (such as ARKit, RoomPlan, StoreKit and Photos). Their availability and behaviour are governed by Apple’s terms. We are not responsible for them.

10. Disclaimer of warranties

To the maximum extent permitted by law, the app is provided “as is” and “as available”, without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, accuracy, non-infringement, and uninterrupted or error-free operation. Some places do not allow certain disclaimers, so some of this may not apply to you.

11. Limitation of liability

To the maximum extent permitted by law, we are not liable for indirect, incidental, special, consequential or punitive damages, or for loss of profits, data, materials or property, arising from your use of or inability to use the app, including costs from relying on a measurement. Our total liability for any claim relating to the app is limited to the greater of the amount you paid us for the app in the 12 months before the claim and US$50. Nothing in these Terms limits liability that cannot be limited by law, including for death or personal injury caused by negligence, fraud, or where consumer law gives you rights that cannot be waived.

12. Termination

You can stop using the app at any time by deleting it. We may suspend or end your access if you break these Terms. Sections that by their nature should survive (such as 3, 7, 10, 11 and 14) will survive.

13. Changes

We may update the app and these Terms. We will update the effective date above and, if a change is significant, notify you in the app. Using the app after a change means you accept the new Terms.

14. Governing law and disputes

These Terms are governed by the laws of India, without regard to conflict-of-law rules. Courts in Surat, Gujarat, India have exclusive jurisdiction, except where your local consumer law gives you the right to bring a claim in your own country.

15. Apple-specific terms

• These Terms are between you and us, not Apple. Apple is not responsible for the app or its content.
• Apple has no obligation to provide maintenance or support for the app.
• If the app fails to conform to a warranty, you may notify Apple and Apple will refund the purchase price (if any). Apple has no other warranty obligation for the app.
• We, not Apple, are responsible for claims about the app, including product liability, legal or regulatory compliance, and consumer protection or similar claims, and for intellectual property infringement claims.
• You confirm you are not located in a country subject to a U.S. Government embargo or listed as a restricted party.
• Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them against you.
